UPICKEM MEN'S COLLEGE BASKETBALL TOURNAMENT CONTEST OFFICIAL
RULES
NO PURCHASE NECESSARY. THIS CONTEST IS INTENDED FOR PLAY IN THE
UNITED STATES AND CANADA ONLY AND WILL BE GOVERNED BY U.S. LAW.
DO NOT PARTICIPATE IF YOU ARE NOT ELIGIBLE AND LOCATED IN THE UNITED
STATES OR CANADA AT THE TIME OF ENTRY.
These Official Rules are for the UPICKEM Men's College Basketball Tournament Contest
(the "Contest"), which is a nationwide contest (including both the United States and Canada)
Sponsored by Second Street Media Inc. ("Sponsor"). Local affiliates who choose to participate
in this Contest may offer prizes for their participants only, but eligibility for those prizes may be
restricted to individuals in the affiliate's local area.
This Contest is not intended to be used for gambling purposes. If it is determined that a
participant is using the Contest for gambling purposes, he/she will be disqualified.
1. ELIGIBILITY: This Contest is open to legal residents of the 50 states of United States and the
District of Columbia, who are 18 years of age or older, and legal residents of Canada (excluding
Quebec), who are of legal age of majority in their province of residence, at the time of entry.
Local affiliates may restrict eligibility for affiliate prizes; eligibility for local affiliate prizes will be posted on the local affiliate's website.
Employees of Sponsor and participating affiliates (the "Promotion Parties"), and members of the
immediate family (spouse, parent, child, sibling and their respective spouse) and households of
each such employee are not eligible to participate or win a prize. This contest is void in Quebec
and where prohibited by law.
2. HOW TO PLAY: In the "Upfront" game, you pick the winner of each game of each round
of the tournament prior to the start of the first full round of the tournament (i.e., the round of 64
teams).
Select the team that you predict will win each game of the Men's College Basketball
Tournament and enter the score for the designated tie-breaker game. You may enter your
picks until fifteen (15) minutes before the start of the first game of the first full round of the
tournament (i.e., the round of 64 teams). You must select a winner for each game or your entry
will not be accepted. You will not be required to pick the winners of the "First Four" play-in
games. Limit one (1) entry per person.
Each round of the tournament is worth up to 64 points. There are 6 rounds in the tournament
worth up to 384 points. You will receive 2 points for each First Round game you pick correctly.
You will receive 4 points for each Second Round game you pick correctly. You will receive 8
points for each Third Round game you pick correctly. You will receive 16 points for each Fourth
Round game you pick correctly. You will receive 32 points for each Fifth Round game you pick
correctly. You will receive 64 points for picking the winner of the Championship game. If a
game is canceled, forfeited, or indefinitely suspended for any reason, that game shall not count
for any participant and scores will be computed as if the game did not exist.
The participant with the highest score for each round will be deemed the round winner, subject to
verification. The participant with the highest total score for all rounds combined will be deemed
the Grand Prize winner, subject to verification of eligibility.
In the event of a tie for the highest score in any round, the winner for the round will be randomly
selected from among the tied participants.
If the event of a tie for the highest overall score, the computer takes those tied participants
that picked the championship game correctly and applies the "Score Approximation Formula"
outlined below to determine the Grand Prize winner.
Score Approximation Formula:
1. Subtract what the participant chose as the score for the winning team from the actual winning
team's score and square this value.
2. Subtract what the participant chose as the score for the losing team from the actual losing
team's score and squares this value.
3. Add the value from 1 and 2 above together to get the participant's "score approximation".
The participant with the lowest "Score Approximation" will be deemed the winner.
If there are still ties, the ties will be broken based on the following criteria in this order:
1. The most points earned in the Fifth Round.
2. The most points earned in the Fourth Round.
3. The most points earned in the Third Round.
4. The most points earned in the Second Round.
5. The most points earned in the First Round.
6. If there is still a tie the computer picks a random winner from the tied players.
National Bonus Prizes:
- One (1) $1,000,000 cash prize will be awarded if a participant correctly picks all 63
games correctly. If more than one participant correctly picks all 63 games correctly, the
$1,000,000 cash prize will be evenly divided and distributed among all participants who
correctly picked all 63 games.
- Up to three (3) $10,000 cash prizes will be awarded to participants who pick 61 or 62
games correctly. If there are more than three participants who correctly pick 61 or 62
game, the three $10,000 cash prizes ($30,000) will be evenly divided and distributed
among all participants who correctly picked 61 or 62 games.
- Up to five (5) $1,000 cash prizes will be awarded to participants who pick 60 games
correctly. If there are more than five participants who correctly pick 60 games, the five
$1,000 cash prizes ($5,000) will be evenly divided and distributed among all participants
who correctly picked 60 games.
Each participant can only win one of these cash prizes. So, for example, a participant who
correctly picks all 63 games would receive the $1,000,000 cash prize, but not a $10,000 cash
prize a or $1,000 cash prize, and a participant who correctly picks 61 or 62 games would
receive the $10,000 cash prize, but not a $1,000 cash prize. These prizes will not be awarded
unless someone correctly picks the required number of games. Determination of cash prize
winners, verification of eligibility, and compliance with these rules will be conducted by SCA
Promotions, Inc., whose decision will be final.
3. WINNER NOTIFICATION: Winners will be notified by email. All posted results are
unofficial until winners are verified. If a winner does not respond within seven (7) days of the
initial notification email, the prize will be forfeited and awarded to the next highest scoring
participant. Prizes won by an eligible participant who is a minor in his/her state of residence will
be awarded to minor's parent or legal guardian who must sign and return all required documents.
Sponsor is not responsible for any change of email address, mailing address and/or telephone
number of participants.
4. GENERAL CONDITIONS: Participants agree to abide by the terms of these Official Rules
and that the decisions of the Sponsor are final and binding on all matters pertaining to the
Contest.
The Promotion Parties reserve the right to substitute any prize with another prize of equal or
greater value. Prizes are non-transferable and no cash equivalent or substitution of prize is
offered, except at the sole discretion of the Sponsor. The Promotion Parties have not made
nor are in any manner responsible or liable for any warranty, representation, or guarantee,
express or implied, in fact or in law, relative to any prize, including but not limited to its
quality, mechanical condition or fitness for a particular purpose. Any and all warranties and/or
guarantees on a prize (if any) are provided only by the manufacturer, and winners agree to look
solely to such manufacturers for any such warranty and/or guarantee. Each winner is responsible
for all federal, state and local taxes and may be required to complete an IRS form W-9. Sponsor
reserves the right to withhold prizes until completed form W-9 is received.
A participant grants to Sponsor and its affiliates the right to use and publish his/her proper name
and state/province or residence online and in print, or any other media, in connection with the
Contest. By accepting a prize, a winner grants Sponsor the right to use his or he name and
likeness for advertising and promotional purposes without further compensation. Participants
agree (a) to release and hold Sponsor, Promotion Parties and all of their respective officers,
directors, employees, representatives and agents from any and all liability for any injuries,
losses or damages of any kind, including death, or property resulting in whole or in part, directly
or indirectly, from acceptance, possession, misuse or use of the prize or participation in this
Contest; (b) that under no circumstances will participants be permitted to obtain awards for any
punitive, incidental or consequential damages; (c) all causes of action arising out of or connected
with this Contest, or any prize awarded, shall be resolved individually, without resort to any form
of class action; and (d) any and all claims, judgments, and award shall be limited to actual out-
of- pocket costs incurred, excluding attorneys' fees and court costs.
5. PRIVACY NOTICE: Information you provide in connection with this contest is subject to
Sponsor's Privacy Policy and will be shared with your local affiliate.
6. LIMITATIONS OF LIABILITY: Sponsor and Promotion Parties are not responsible for
Internet crashes or slowdowns caused by network congestion, viruses, sabotage, satellite failures,
phone line failures, electrical outages, natural disasters or acts of man or God, lost, late,
misdirected, postage-due, unintelligible, returned, undelivered entries or email, or for lost,
interrupted or unavailable satellite, network, server, Internet Service Provider (ISP), Website, or
other connections availability, accessibility or traffic congestion, miscommunications, failed
computer, network, telephone, satellite or cable hardware or software or lines, or technical
failure, or jumbled, scrambled, delayed or misdirected transmissions, computer hardware or
software malfunctions, failures or difficulties, or other errors of any kind whether human,
mechanical, electronic or network. Persons who tamper with or abuse any aspect of this Contest
or Website, or act in violation of the Official Rules, or act in any manner to threaten or abuse or
harass any person, or violate Website's terms of service, as solely determined by the Sponsor,
will be disqualified. Neither Sponsor nor Promotion Parties are responsible for any incorrect or
inaccurate information whether caused by Website users, tampering, hacking, or by any of the
programming or equipment associated with or used in this Contest, and assumes no responsibility
for any errors, omission, deletion, interruption or delay in operation or transmission or
communication line failure, theft or destruction or unauthorized Website access. Any use of
robotic, macro, automatic, programmed or like methods of play will void all such plays, and may
subject that participant to disqualification. Sponsor reserves the right at its sole discretion, to
disqualify any individual (and all of his or her submissions) who tampers with the submission
process. Neither Sponsor nor Promotion Parties are responsible for injury or damage to
participant's or any other person's computer or property related to or resulting from participating
in this Contest. Should any portion of Contest be, in the Sponsor's sole opinion, compromised by
virus, worms, bugs, unauthorized human intervention or other causes which, in the sole opinion
of the Sponsor, corrupt or impair administration, security, fairness or proper play of this Contest,
or Contest plays, Sponsor reserves the right at its sole discretion to suspend, modify or terminate
the Contest.
7. WINNERS: For a list of national winners, mail a self-addressed, stamped envelope to: Second

2012 WSAZ BRACKETOLOGY PICK’EM CONTEST OFFICIAL RULES
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING.
1. PROMOTION DATES
a. The 2012 WSAZ BRACKETOLOGY PICK’EM CONTEST (“Promotion”) will begin on March 11, 2012 at 8:00PM ET and end on April 2, 2012 at 11:59:59PM ET.
2. ELIGIBILITY RESTRICTIONS
a. The Promotion is open to all legal residents of the United States and the District of Columbia (except NY and FL) who are 18 years of age or older at the time of entry and who live in THE COUNTIES IN OHIO, WEST VIRGINIA AND KENTUCKY COVERED BY WSAZ’S SERVICE AREA/NIELSEN DESIGNATED MARKET AREA. Employees of WSAZ (the “Station”), its parent, subsidiary, and affiliated entities, its advertising agencies, participating sponsors/promotional partners, other broadcasting stations in the CHARLESTON-HUNTINGTON TELEVISION MARKET and the members of their immediate families (spouse, parents, siblings or children) or households (whether related or not) are ineligible to participate or win. This Promotion is subject to all applicable federal, state, and local laws and regulations. Void outside the United States, in NY and FL, as applicable, and where prohibited.
b. Only one winner per household is permitted in any Station-conducted contest/sweepstakes.
c. Entrants are required to provide truthful information and the Station will reject and delete any entry that it discovers to be false or fraudulent. The Station will disqualify any entry from individuals who do not meet the eligibility requirements, and will also delete any entry as required by law.
3. ENTRY
a. To participate in the Promotion, you may enter via the following method(s):
VIA INTERNET – Access the link: http://wsaz.collegehoops.upickem.net/collegebasketball/registration/login.asp. Register for the contest or use previously created log in credentials. If you have a Facebook log in you may use that. You may register and make your selections for the “up front” contest up to 15 minutes prior to the tip off of game 1 on March 15th. The contest computer is the official time piece for the contest. For the round by round contest you may make your picks for each round up to 15 minutes before the tip off of that round. See how to play below for complete details. Follow the links and instructions to enter and complete the required fields in the online entry form. Internet entries will be deemed made by the authorized account holder of the email address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the email address by an internet access provider, online service provider or other organization that is responsible for assigning the email address or the domain associated with the submitted email address. Multiple entrants are not permitted to share the same email address. Entries submitted will not be acknowledged or returned. Use of any device to automate entry is prohibited. Proof of submission of an entry shall not be deemed proof of receipt by Station. The contest/sweepstakes administrator’s computer is the official time keeping device for the Promotion. For purpose of this Promotion, a “Day” shall begin at 12:00:00 a.m. ET and shall end at 11:59:59 p.m. ET.
All entrants must follow the “call to action” entry instructions and submit any requested information. By submission of an entry in this contest, entrants hereby expressly consent to the receipt of a confirmatory bounce-back message related to this contest. Any mobile device entry entries will be deemed made by the authorized account holder of the mobile account submitted at the time of entry. The authorized account holder is the natural person who is assigned to the text or mobile telephone number by a telecommunications provider, or other organization that is responsible for assigning such numbers. Multiple entrants are not permitted to share the same text or mobile telephone number. Use of any device to automate entry is prohibited. Proof of submission of an entry shall not be deemed proof of receipt by Station. The contest/sweepstakes administrator’s telephone system is the official time keeping device for the Promotion. For purpose of this Promotion, a “Day” shall begin at 12:00:00 a.m. ET and shall end at 11:59:59 p.m. ET
VIA ADMINISTRATION ON FACEBOOK Each entry via Facebook must include requested/required information in the contest entry form.
This Promotion is in no way sponsored, endorsed or administered by, or associated with Facebook. By submission of an entry, an entrant releases Facebook from any responsibility or liability for the Promotion’s administration, prizes or promotion. You are providing entry information to WSAZ’s Bracketology Pick’em Contest and not to Facebook.

b. There are no local WSAZ prizes. There is no substitution, transfer, or cash equivalent for prizes, except that the Station may, at its sole discretion, substitute prizes of comparable value or cash. The prizes are expressly limited to the item(s) listed above and do not include taxes, gratuities or any other expenses. A winning player of a prize in excess of $600 in value will be required to file an IRS form 1099 and will be responsible for all local, state and federal taxes on those winnings. Other restrictions may apply.
c. Decisions of Station management with respect to the Promotion are final.
d. Winners are selected as described above in the “How to Play” paragraph.
5. WINNER NOTIFICATION: Winners will be notified by email. All posted results are unofficial until winners are verified. If a winner does not respond within seven (7) days of the initial notification email, the prize will be forfeited and awarded to the next highest scoring participant. Winners (or their parents or legal guardians if under the age of majority) must execute and return any required affidavit of eligibility and/or liability/publicity release within ten (10) days of notification attempt or winner will be disqualified and the prize will be forfeited and an alternate winner may be chosen by the next highest points total. If a potential winner cannot be contacted, fails to complete, sign and return the required affidavit of eligibility and liability/publicity release within the required time period, or if a prize or prize notification is returned as undeliverable, the potential winner will be disqualified and will forfeit the prize.
a. Unless otherwise specified in the prize notification, all prizes or prize certificates may be delivered by Second Street Media at the address below. The winner will forfeit any prize or prize certificate not claimed within thirty (30) days of winning. Prize or prize certificates will not be mailed to the winner without the winner’s prior written consent in which the winner shall agree to assume its risk of loss. The Station, its sponsor, or promotional partner(s) are not responsible for the safe arrival of a prize or prize certificate.
6. CONDITIONS
a. Payments of all federal, state and local taxes are solely the responsibility of the winners. Winners will be required to complete and submit an IRS Form W-9 or the equivalent including the winner’s full Social Security Number for receipt of any prize valued at $600 or more or for any prizes awarded by the Station in a calendar year with an aggregate value of $600 or more. Failure to submit a complete W-9 or equivalent will result in disqualification and forfeiture of the prize.
b. Participating in the Promotion and acceptance of prize constitutes winner’s and guest’s (where applicable) permission for the Station or its agents to photograph, film and record each winner, and to use his/her name, address (city and state), likeness, photograph, voice, biographical information and/or any statements made by him/her regarding the Promotion or its sponsors for purposes of trade, publicity or promotion without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize.
c. Prior to awarding any prize or prize certificate, and depending on the nature of the prize and eligibility requirements of the Promotion, the Station in its sole discretion will require verification of Promotion winner’s identification by a showing of valid government-issued photo identification. By participating and/or accepting a prize, entrants, winners and guests (if applicable) agree to release and hold harmless the Station, its sponsor(s) and promotional partner(s), its advertising and promotion agencies, and each of their respective parent, subsidiary and affiliated entities, and the officers, shareholders, directors, employees, agents, representatives, successors, and assigns of each of them (collectively, the “Released Parties”) harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the Promotion. The Station will also require eligible Promotion winners and their guests or travel companions, if any (as well as each of their parent(s) or legal guardian(s), if winners, guests or travel companions are under the age of majority in their state of residence), to sign a liability release confirming such consent.
d. The Station, in its sole discretion, reserves the right to disqualify any person (and all of their entries) from this Promotion if he or she tampers with the entry process, the operation of the Promotion, or the operation of the Station’s web channel or is otherwise in violation of the rules. The Station further reserves the right, at its sole discretion, to modify, cancel, terminate or suspend the Promotion, or any part of it, if it is not capable of completion as planned or if any fraud, technical failures or any factor beyond the Station’s control, including infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort, corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion as determined by the Station in is sole discretion. Any attempt by an entrant or any person to deliberately damage any station web channel or to undermine the legitimate operation of this Promotion may be a violation of criminal and civil laws. Should such an attempt be made, the Station reserves the right to seek full prosecution and/or damages from any such individual to the fullest extent permitted by law. The Station’s failure to enforce any term of these Official Rules shall not constitute a waiver of this provision. If due to circumstances beyond the control of the Station, any competition or prize-related event or travel is delayed, rescheduled, postponed or cancelled, the Station reserves the right, but not the obligation, to modify, terminate, suspend or cancel the Promotion and shall not be required to award a substitute prize.
e. The Released Parties are not responsible for (i) typographical or other errors in the printing, the offering or the administration of the Promotion, or in the announcement of a prize; (ii) entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties, malfunctions, disconnections, other technological failures, telephone service outages, delays, dropped calls, or busy signals, or any other difficulties that may prevent an individual from sending or receiving a text message; or (iii) lost, stolen, mangled, misdirected, postage due, illegible, incomplete, incorrect, or late entries. Further, the Released Parties are not responsible if any part of a Promotion prize that cannot be awarded due to acts of god, acts of war, natural disasters, weather, acts of terrorism or other factors beyond the Station’s control.
f. To obtain a copy of the Official Rules or a list of winners following completion of the Promotion (please specify which), send a self-addressed, stamped envelope (VT residents may omit return postage) specifying “Official Rules” or “Winner List” to 2012 WSAZ Bracketology Pickem Contest Winner List or Official Rules Request, WSAZ TV 645 Fifth Avenue, Huntington, WV 25701. A copy of the Official Rules and a list of winners (when complete) are also available during regular business hours at the main studio of WSAZ TV 645 Fifth Avenue, Huntington, WV. All such requests must be received within thirty (30) days following completion of the Promotion.
7. TERMS OF USE AGREEMENT & PRIVACY POLICY
a. By use of this web channel and by entering this Promotion, you agree to the Station’s Terms of Use Agreement and to the use of your personal information as described in the Privacy Policy located at: http://www.wsaz.com/unclassified/34218884.html.
